    I, JAMES MARAPE, Prime Minister, by virtue of the powers conferred
    by Sections 2 and 18 of the Commission of
    Inquiry Act (Chapter 31) and all other powers me enabling, hereby —
    (a) establish the Commission of Inquiry into the sale and purchase
    of the Motukea Wharf; and
    (b) appoint Don Pela Sana Pomb Polye as Chairman, and Dr. John
    Kuwimb and Sike Toulik as
    Commissioners of the Commission of Inquiry into the Sale and
    Purchase of Motukea Wharf; and
    (c) direct Department of Treasury to immediately make available K6.0
    million to assist the Prime Minister
    with the establishment of the Commission of Inquiry; and
    (d) direct the following State Agencies and bodies to assist the
    Commission of Inquiry by providing, sharing
    and analysing statistics and information to expedite the
    investigation and conclude the Inquiry within its
    required timeframe:

    SCHEDULE 1
    TERMS OF REFERENCE
    (i) Investigate and report on the economical and commercial
    implications on the sale and purchase of the
    Motukea Wharf;
    (ii) investigate and report on the present commercial situation
    of the Motukea Wharf and the same for the old
    wharf and their ownership;
    (iii) investigate and establish the sale and purchase price as
    to the method of transaction and if the value at
    which the Motukea Wharf was sold and purchased was
    justified;
    (iv) investigate and report on the specific assets sold and if
    it was legally correct and relevant laws were
    compiled with;
    (v) investigate and establish the process employed in the
    transaction and if it was legally correct and relevant
    laws were compiled with;
    (vi) study and reveal if any anomalies, any special favors done
    or any extra-ordinary activities that may have
    occurred in the transaction;
    (vii) establish if it was the decision of Ports PNG to abandon
    the old Port for the Motukea wharf and if
    the decision had merit. Ascertain also if the decision was
    endorsed by Cabinet and if so, on what terms
    and conditions. Investigate if Cabinet decisions were
    followed thoroughly and correctly. Investigate if all
    legal processes were followed in the decision making
    process;
    (viii) assess and establish the social, environmental and
    commercial implications by the change of location. For
    example, if business conducted on the Motukea Port is
    proficient today. Or if commercial viability of
    Motukea Port outweights businesses undertaken at the old
    Port;
    (ix) other tasks as directed by the Prime Minister and National
    Executive Council or Secretary of the
    Department of the Prime Minister and Office of the Prime

    (x) make recommendations for prosecution of illegal activities
    and if necessary recommend for the
    recoveries of monies lost through any illegal or criminal
    conduct in the transaction.
    SCHEDULE 2
    PAYMENT FOR SERVICES
    Commission of Inquiry Period
    The Investigation is to commence upon being commissioned from
    December 2020 up to and including end of
    April 2021.

    Remuneration of Commissioners
    The Commission shall provide an invoice before the commencement
    of work and another at the end of the
    investigation period. Total amount not exceeding K3.7 million for
    the whole investigation period.
    The payment shall be made in two tranches. The first tranche of
    50% to be paid upfront to commence the
    investigation. The balance of remuneration mount (K3.7 million) to
    be paid at the end of the investigation period.
    The invoice shall be provided in accordance with following break
    up:
    (a) Motukea Wharf Sale and Purchase Commission of Inquiry at
    K3.7 million;
    (b) support service for the Commission of Inquiry at K1.7
    million.

    (Management) Act 1995 and other Acts, support

    Palman as insolvent on 01st June 2017 made
    by the Court is annulled forthwith and a copy of the Order

    annulling the adjudication of the debtor
    Bari Palma as insolvent be published without delay in the National

    Gazette and advertised locally in one of the
    Daily newspapers.

    2. The Court accepts the revised amount of K171,969.06 as
    determined by the National Court on 24th October

  • 2017 in EP NO. 93 of 2012 and that amount is
    the final amount being owed by the Applicant/Respondent.

    3. The amount of K171, 969.06 has been fully
    paid by the Respondent and accepted by the Petitioner as costs

    of the election petition in EP No. 93 of
    2012.

    4, The Respondent’s insolvency as pronounce by
    the National Court on the 01st of June 2017 is set aside.

    5. The Respondent, Bari Palma, adjudication as
    insolvent on 01st June 2017 be annulled forthwith.

    6. Each party shall pay their own costs.

    7. The time of this entry of these orders is
    abridged to the time and date of settlement by the registrar which

    shall take place forthwith.
